| University | University Of Portsmouth (UOP) |
| Subject | U25832: European and International Human Rights Law |
Coursework assignment:
Please write a commentary on the application of the principle of
proportionality by the European Court of Human Rights in the case of
Barbulescu Romania.
General:
This coursework assignment requires you to write a case commentary on a recent ECtHR judgment. You are specifically asked to write the commentary on how the Court approached the principle of proportionality.
Sources:
As the Grand Chamber judgment is relatively recent, you are unlikely to find an
abundance of “traditional” secondary sources discussing it. However, the underlying issue of proportionality is something that has been discussed extensively in the ECHR literature and these scholarly opinions might be useful.
